Cocolor mobile application

ARTICLE 1 : Purpose
The purpose of the present terms and conditions of use is to provide a legal framework for the use of the Cocolor mobile application (hereafter referred to as the application, the mobile application or Cocolor app), and its services.
This contract is concluded between :
· The publisher of the Cocolor mobile application, hereinafter referred to as "the Publisher",
· Any individual or legal person wishing to access the Cocolor mobile application and its services, hereinafter referred to as "the User".
The general conditions of use must be accepted by all Users, and their access to the application constitutes acceptance of these conditions.

Cocolor is published by the company Hérétique SAS with a capital of 3000 €, whose head office is located at 35 rue le Marois 75016.

ARTICLE 3 : Description and access to the services
Cocolor is a color playing app with two first games, Am I blue? and Tea for Two.
Am I Blue? : A color building challenge
The goal of the game is to make the little guy in the drawing disappear by mixing three primary pigments to match the background color. To do this you gradually add cyan, yellow and magenta as you attempt to get ever closer to the target color. Take your time, because there’s no going back when your color mixture gets too dark!
Will you be able to match six colors in a row? Or would you rather just relax and create a series of Andy Warhol style portraits?
Tea for Two : A dueling tea party
Tea for Two is played by two people. Challenge yourself to match the background color on your side before your opponent matches theirs.
In this game, you can add and also subtract primary pigments if you go too far. If your opponent wins, you offer them a cup of tea. The first player to match 3 colors wins the round, with all their colors shaping the final landscape.
The User of Cocolor has access to those two first games, and may access new games in the future, upon updating of the Cocolor app.
Any User with access to the internet via a sufficiently recent Android or iOS phone can access Cocolor free of charge from the available Google Play Store and the Apple App Store. The costs incurred by the User to access it (internet connection, computer equipment, etc.) are not borne by the Publisher.
Cocolor and its various services may be interrupted or suspended by the Publisher, in particular during maintenance, without any obligation to give notice or justification.
ARTICLE 4 : Responsibility of the User
The User is responsible for the risks associated with the use of Cocolor.
The User agrees to use Cocolor in a manner that is respectful of others.
ARTICLE 5 : Responsibility of the Publisher
The Publisher cannot be held responsible for any malfunction of the server or the network.
Likewise, the Publisher shall not be held liable in the event of the unforeseeable and insurmountable event or act of a third party.
ARTICLE 6 : Intellectual Property
The contents of Cocolor (logos, texts, graphic elements, videos, etc.) are protected by copyright, in accordance with the Intellectual Property Code.
The User must obtain the Publisher's authorisation before any reproduction, copy or publication of these different contents.
The latter may be used by users for private purposes; any commercial use is prohibited.
The User is entirely responsible for any content he/she puts online and undertakes not to harm any third party.
The User is entitled to share externally its results to Am I Blue? and Tea for Two.
ARTICLE 7 : Personal data
The User does not have to provide any personal data to access the Cocolor services.
ARTICLE 8 : Evolution of the general conditions of use
Cocolor reserves the right to modify the clauses of these general conditions of use at any time and without justification.
ARTICLE 9 : Duration of the contract
The duration of the present contract is indefinite. The contract takes effect with regard to the User from the start of the use of the service.
ARTICLE 10 : Applicable law and competent jurisdiction
This contract is governed by French law.
In the event of a dispute between the User and the Publisher that cannot be resolved amicably, the courts of Paris shall have jurisdiction to settle the dispute.
